§ 210. Lots on which principal buildings, structures, and uses are established must abut street.

  • 210.1 Except as provided in Section 210.2 of this ordinance, no principal building, structure, or use may be erected or established on any lot which does not abut at least twenty (20) feet on one of the following:

    210.1.1 A public street dedicated to and maintained by the Town of Smithfield or the North Carolina Department of Transportation;

    210.1.2 A street constructed to the standards of the Town of Smithfield, or the North Carolina Department of Transportation, with a written agreement concerning maintenance of the street.

    210.2 The Town Council may authorize, as a special use, the erection or establishment of a principal building, structure, or use on a lot not meeting these requirements if it is clear that adequate provision for access for the type and intensity of use proposed has been or will be provided, and there are special circumstances, such as the rural nature of the lot and area, which make the application of these requirements to the proposed use infeasible or undesirable.
